Uwarunkowania mediacji jako metody rozwiązywania konfliktów międzyorganizacyjnych

Mediation was formally institutionalized at the turn of the 19th and 20th centuries. In Poland, organizations can formally use mediation from December 10, 2005. The most common source of information is the courts. Almost 4% of economic cases go to mediation from Polish courts, but over 70% do not reach it because organizations do not agree to it. In situations where such consent was expressed, more than 50% of cases resulted in an agreement. Statistics of the Ministry of Justice in this area prompted the author to explore the area related to mediation between organizations. The dissertation concerns the conditions of mediation in Poland as a method of resolving conflicts between two or more organizations. The author of this dissertation introduces the notion and definition of inter-organizational mediation. The aim of the doctoral thesis is to identify factors that favor the organization's consent to mediation and settlement and verify whether and how the duration of the proceedings affects the conclusion of the agreement. The modeling involved three aspects related to mediation: the fact of its existence, the fact of settlement, the time of mediation. The analysis of collected empirical material indicated factors in the area of organization, court and mediator, which proved to be important in the perspective of consent, settlement and mediation time.
